Immer wieder werden an den Berufsfachverband für Radiologietechnologie Österreich
(rtaustria) Anfragen zur Patientenaufklärung und zur Zuständigkeit bezüglich der
Aufklärung gestellt. Die „Auskunftsverpflichtung“ ist explizit im MTD-Gesetz und
weiters im Ärztegesetz geregelt. „Aufklärung“ als Begriff kommt in keinem der
beiden Gesetze vor. Dieser Artikel beschäftigt sich mit den Begrifflichkeiten
und dem dahinterliegenden Bedeutungszusammenhang.
Abstract
The Austrian Radiological Technology Association (rtaustria) is often
asked about patient information. The question arises as to who is
responsible for providing information. This article describes the situation
in Austria. The “duty to inform” is explicitly regulated in the
MTD Act and also in the Medical Practitioners Act. The term “information”
does not appear in either of these laws. In everyday language,
the two terms are often used interchangeably. However, there is
a legal and semantic difference between the two terms. This article
deals with both terms and the underlying (including legal) context
of their meaning.
