Abrechnung unterdosierter Arzneimittel

Zusammenfassung

Der Beitrag befasst sich mit der Zulässigkeit der Abrechnung unterdosierter Arzneimittel durch einen Vertragsarzt gegenüber der für den Arzt jeweils zuständigen Kassenärztlichen Vereinigung auf Grundlage des EBM-Ä sowie durch einen privat liquidierenden Arzt nach der GOÄ. Konkret wird untersucht, ob der Arzt nach Durchführung der Radiosynoviorthese für das hierbei unmittelbar dem Patienten verabreichte Radionuklid stets die gleiche Pauschale abrechnen kann, auch wenn er bei dem Patienten eine Dosierung zum Einsatz gebracht hat, welche unterhalb der zugelassenen Dosierungsspanne liegt. Im Schwerpunkt geht es um eine mögliche Betrugsstrafbarkeit nach § 263 StGB. Weitere Risiken berufs- und disziplinarrechtlicher Verfahren werden aufgezeigt.

Abstract

The article deals with the admissibility of the billing of underdosed drugs by a national health doctor, who treats non-privately insured patients, but statutory health insurance patients, towards the regional Association of Statutory Health Insurance Physicians, which is responsible for each doctor, on the basis of the uniform value scale of fees for doctors and by a privately liquidating physician according to the official german scale of fees for doctors. Specifically, it is investigated whether the doctor can always charge the same flat rate for the radionuclide administered directly to the patient after carrying out the radiosynoviorthesis, even if he has used a dosage for the patient which is below the permitted dosage range. The focus is on a possible criminal liability of fraud according to § 263 of the german penal code. Further risks of professional and disciplinary proceedings are highlighted.
