Zwangsbehandlung bei Anorexia nervosa

Zusammenfassung

Die Anorexia nervosa zählt zu den psychischen Erkrankungen mit sehr hoher Mortalität. Wenn die Essstörung etwa bei einem BMI < 13 kg/m² ein lebensbedrohliches Ausmaß erreicht, sollte auch die Möglichkeit einer Zwangsbehandlung erwogen werden. Da eine Zwangsbehandlung die vom Grundgesetz geschützte Freiheit und körperliche Unversehrtheit verletzt, muss das Vorliegen der gesetzlichen Voraussetzungen sorgfältig geprüft werden. Eine Zwangsbehandlung und Zwangsernährung gegen den Willen der Patienten beeinträchtigt deren Selbstbewusstsein und Selbstvertrauen. Dies behindert das wichtige Ziel, Patienten für die Psychotherapie zu motivieren. Bis heute finden sich in der Literatur nur wenige Berichte über die Zwangsbehandlung bei Anorexia nervosa. Die vorliegende Übersichtsarbeit referiert die psychiatrische Literatur und wichtige Gerichtsentscheidungen zu diesem Thema. Abschließend werden Empfehlungen für die Zwangsbehandlung der Anorexia nervosa vorgestellt und psychotherapeutische, ethische und juristische Aspekte diskutiert.

Abstract

Anorexia nervosa is a psychiatric disorder with a very high mortality rate. If the eating disorder reaches life threatening severity, for example through a body mass index lower than 13 kg/m², the possibility of compulsory treatment has to be considered. However, civil commitment of patients and forced feeding against their will may reduce self confidence and self esteem. This impedes the important goal of motivating patients to undergo psychotherapy. Furthermore, compulsory treatment is regarded as a contravention of the patient's physical inviolability as enshrined in the German Constitution. Up to now only a few studies about the use of guardianship legislation for anorexia nervosa have been published. The present paper reviews psychiatric literature and significant judgements of German courts on this topic. It finishes by examining clinical issues on forced feeding and possible consequences for psychotherapy.
