Zusammenfassung
Die Richtlinien der Bundesärztekammer zur Transplantationsmedizin sind
eingebunden in das Gesamtsystem der Organtransplantation in Deutschland, wie
es gesetzlich durch das Transplantationsgesetz vorgegeben ist. In diesem
System obliegt es der Bundesärztekammer, als Zusammenschluss der
Ärztekammern auf Bundesebene, den Stand der medizinischen Wissenschaft zu
den medizinischen Fragestellungen festzustellen, die für die Aufnahme von
Patienten in eine bundeseinheitliche Warteliste und die darauf basierende
Allokationsentscheidung maßgeblich sind. Diese Feststellungen begründen die
Vermutung der Richtigkeit, als Grundlage für die an den betreffenden
Entscheidungsprozessen beteiligten Institutionen. Der folgende Beitrag setzt
sich mit diesen Richtlinien, ihrer rechtlichen Legitimation und der zu ihren
Inhalten geäußerten Kritik auseinander und strebt damit für die in den
Organspendeprozess eingebundenen Mitarbeiter der Krankenhäuser und der DSO
ein notwendiges Maß an Rechtssicherheit an.
Abstract
The guidelines of the German Medical Association on transplantation medicine
are integrated into the entire system of organ transplantation in Germany,
as is legally required by the German Transplant Act. In this system, the
German Medical Association, as an amalgamation of medical chambers at the
national level, is obligated to determine the current state of medical
science with regard to those medical questions that are relevant for the
acceptance of patients in a single national waiting list and for the
allocation decisions based thereupon. These findings establish the
presumption of conformity as a foundation for the respective decision-making
processes of the involved institutions. The present article analytically
appraises these guidelines, their legal legitimation and the criticisms
expressed regarding their content and thus attempts to provide the personnel
involved in the organ donation processes in hospitals and in the German
Foundation for Organ Transplantation [Deutsche Stiftung Organtransplantation
(DSO)] with the required amount of legal security.
